General provisions

1. About OVYRAN

OVYRAN is an independent information and coordination service.

OVYRAN is not a hospital, clinic, medical practice, healthcare provider or emergency medical service.

The service is intended to help individuals organize information and navigate the organisational aspects of seeking healthcare.

2. Nature of the service

Depending on the circumstances of an enquiry, OVYRAN may:

  • receive and organize information provided by a client;
  • structure information contained in documents;
  • summarize information provided by the client;
  • identify and organize publicly available information;
  • facilitate communication with healthcare institutions or other relevant organisations when requested by the client;
  • assist with non-medical organisational matters connected with an international or cross-border healthcare enquiry;
  • help the client understand the information available to them and the organisational options that may exist.

The scope of assistance depends on the circumstances of each individual enquiry.

3. What OVYRAN does not provide

OVYRAN does not:

  • diagnose diseases or medical conditions;
  • provide medical opinions or medical conclusions;
  • determine medical indications or contraindications;
  • determine whether a particular treatment is medically appropriate;
  • prescribe medication;
  • select or prescribe a treatment plan;
  • make decisions concerning surgery or other medical procedures;
  • determine which doctor or healthcare institution a client should use;
  • guarantee that a particular treatment, doctor, hospital or healthcare institution will be suitable for a particular person;
  • replace the professional judgment of a qualified healthcare professional.

Any medical assessment, diagnosis, treatment decision or clinical recommendation must be made by an appropriately qualified healthcare professional.

4. Client responsibility

The client remains responsible for decisions concerning their healthcare.

The client is responsible for providing information that is accurate and sufficiently complete for the organisational purpose for which it is provided.

The client should independently verify medical information and discuss medical decisions with qualified healthcare professionals.

5. Healthcare institutions and third parties

OVYRAN may identify, describe or provide publicly available information concerning hospitals, clinics, medical centres, healthcare networks, doctors or other healthcare-related organisations.

Different organisations may have different structures, ownership, facilities, specialties, affiliations and relationships.

OVYRAN does not represent a hospital, clinic, medical centre or healthcare network unless a specific formal relationship is expressly stated.

The appearance of a healthcare institution on the OVYRAN website or in information provided to a client does not constitute:

  • a recommendation;
  • an endorsement;
  • a guarantee of quality;
  • a guarantee of treatment outcome;
  • a guarantee of availability;
  • a statement that the institution is medically appropriate for a particular person;
  • evidence of a formal partnership.

Where OVYRAN has a formal relationship with a particular organisation, that relationship will be described separately and accurately.

6. Accuracy of third-party information

OVYRAN may rely on information made available by healthcare institutions, public authorities, professional organisations and other third parties.

Such information may change over time.

OVYRAN may organize and communicate publicly available information but does not guarantee that every third-party statement, price, availability, facility description, medical claim or other item of information remains current, complete or error-free.

Where a matter is important to a client's decision, the client should verify the current information directly with the relevant organisation.

7. No guarantee of outcome

OVYRAN does not guarantee:

  • access to treatment;
  • acceptance by a healthcare institution;
  • availability of a doctor or procedure;
  • a particular treatment outcome;
  • recovery or improvement;
  • cost;
  • duration of treatment;
  • visa or travel arrangements;
  • insurance reimbursement;
  • any other result dependent on a third party.

8. Client documents

A client may provide medical records and other documents for the limited purposes described in the Privacy Notice and applicable consent.

OVYRAN will not treat the receipt of a medical document as an assumption of medical responsibility for the person concerned.

9. Communication with healthcare institutions

Where requested or authorised by a client, OVYRAN may assist with communication or the organisational exchange of information with a healthcare institution or another relevant organisation.

As OVYRAN coordinates processes involving hospitals located in India, information related to an enquiry may be shared with organisations located outside the client's country of residence, including India.

The receiving organisation remains responsible for its own decisions, procedures and services.

OVYRAN does not control the decisions, policies, medical practices or treatment provided by third parties.

10. Fees

The scope and level of assistance available through OVYRAN may vary.

Where a specific paid service is agreed, the applicable scope, fee, payment arrangements and other material terms will be communicated to the client before the service is undertaken.

A reference to a service level or indicative fee on the OVYRAN website does not by itself constitute an obligation to enter into a paid engagement.

No payment is processed through the OVYRAN website unless a separate payment arrangement is expressly introduced.

11. Separate service agreement

Where a client and the operator of OVYRAN agree to a paid engagement, the parties may enter into a separate written service agreement identifying the parties, scope of work, fee and other applicable terms.

In the event of a conflict between these Terms and a later written service agreement specifically agreed for a particular engagement, the specific agreement will govern that engagement to the extent of the conflict.

12. Privacy

Personal information is handled in accordance with the OVYRAN Privacy Notice.

Where medical or health-related information is involved, additional safeguards and legal requirements may apply.

13. No emergency service

OVYRAN is not an emergency medical service.

If you are experiencing a medical emergency, contact the appropriate local emergency service or seek immediate medical attention.

OVYRAN should not be used as a substitute for urgent medical care.

14. Intellectual property

Unless otherwise stated, the OVYRAN website, its original text, structure, design and other original materials are provided by or for OVYRAN and may not be reproduced or commercially exploited without appropriate permission.

Third-party names, logos, trademarks and materials remain the property of their respective owners.

15. Changes to the service

OVYRAN may modify, suspend or discontinue parts of the website or service where reasonably necessary.

Information and service descriptions may also be updated from time to time.

16. Changes to these Terms

These Terms may be updated from time to time.

The version published on the OVYRAN website will indicate its effective date.

17. Contact

For questions concerning these Terms or the OVYRAN service, reach us via the contact page or at privacy@ovyran.com.

Where a specific paid engagement is entered into, the relevant service agreement may contain additional contact and contractual information.

18. Applicable law

The applicable law and dispute-resolution arrangements may depend on the legal status and location of the service provider, the client's location, the nature of the engagement and mandatory rules applicable to the particular relationship.

Nothing in these Terms is intended to exclude or limit mandatory rights that cannot lawfully be excluded or limited.

Where a separate written service agreement is entered into, that agreement may specify the applicable law and dispute-resolution arrangements to the extent permitted by applicable law.
